This website is operated by Haven Surf. Throughout the site, the terms “we”, “us” and “our” refer to Haven Surf. Haven Surf offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Belgium.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our website. SECTION 20 - SHIPPING

We aim to dispatch all orders as quickly as possible. Delivery times vary by destination, carrier and customs procedures and are provided as estimates only. Delays caused by carriers, customs authorities, weather conditions or other circumstances beyond our control do not entitle the customer to cancel an order, refuse delivery or claim compensation. Once an order has been shipped, Haven Surf is not responsible for delays caused by the carrier or customs authorities.

SECTION 22 - LOCAL LEVIES

Import duties, taxes, customs clearance fees and any other charges imposed by local authorities are the responsibility of the customer.Haven Surf has no control over these charges and cannot predict their amount. These charges are determined by the destination country’s customs authorities and may vary depending on the product category, country of origin and local regulations.

SECTION 23 - VAT EXEMPT PURCHASES (FOR CUSTOMERS OUTSIDE OF THE EUROPEAN UNION)

When shopping from outside the European Union, Belgian VAT (21%) is automatically removed at checkout once a non-EU shipping destination is selected.

Prices displayed on our website do not include shipping charges, import duties, customs clearance fees, local taxes or carrier handling charges unless explicitly stated otherwise.

The removal of Belgian VAT does not guarantee that your order will be exempt from duties or taxes in your destination country.

Any applicable duties, taxes, customs clearance fees or carrier handling charges remain the responsibility of the customer.

If a shipment is refused, abandoned, unclaimed or returned to us due to non-payment of duties, taxes, customs charges or carrier fees, Haven Surf reserves the right to deduct all shipping costs, return shipping costs, customs charges, carrier handling fees and any other costs incurred from the refund amount.

UK TAX AND DUTY

For orders with a value of £135 or less, UK VAT will be charged at checkout in accordance with applicable UK regulations. Orders over £135 are processed without Belgian VAT. UK import VAT and any applicable customs charges will be collected by the carrier or UK customs authorities before or upon delivery.

U.S. TAX AND DUTY

When shopping from outside the European Union, Belgian VAT (21%) is automatically removed at checkout. U.S. customs regulations may change over time. Duties and taxes may apply depending on the product category, country of origin and the regulations in force at the time of import. Not all products are subject to duties.

We ship to the United States using FedEx. If applicable, FedEx will contact you directly regarding payment of duties and taxes before or after delivery.

REST OF WORLD (OUTSIDE THE EU, UK AND U.S.)

When shopping from outside the European Union, Belgian VAT (21%) is automatically removed at checkout. Depending on your country’s import regulations, local customs duties, taxes, customs clearance fees or carrier handling charges may apply when your order arrives.

These charges are determined by local authorities and carriers and remain the responsibility of the customer. If applicable, FedEx or the designated carrier will contact you directly regarding payment before or after delivery.

SECTION 24 - RETURNS & REFUNDS

Customers have the right to return eligible products within 14 days of receiving their order, in accordance with our Returns Policy. Returned items must be unused, unworn, in their original condition, with all tags attached and in their original packaging. Original shipping costs are non-refundable unless required by applicable law. Refunds will be processed after the returned goods have been received and inspected.

For orders shipped outside the European Union, any duties, taxes, customs fees, return shipping costs, carrier handling fees or other charges incurred during the return process may be deducted from the refund amount. Certain items may be excluded from returns for hygiene, safety or custom-order reasons. Please consult our Returns Policy for full details.

SECTION 25 - SURFBOARDS

Surfboards are carefully inspected before shipment and packed using industry-standard protective materials. Customers are responsible for inspecting the package upon delivery. Any visible shipping damage should be reported immediately to the carrier and to Haven Surf. Any shipping damage must be reported to Haven Surf within 48 hours of delivery and supported by clear photographs of both the surfboard and its packaging.

Custom-made surfboards, special-order surfboards and surfboards specifically produced or sourced for a customer cannot be cancelled, exchanged or returned unless they are defective or damaged upon arrival.
